What Excess Funds Is

In Georgia, money left over after a delinquent property tax sale is called excess funds. Unlike most states, the funds are held by the county Tax Commissioner rather than a court clerk, and each county publishes its own excess funds list.

Excess funds belong to the parties with a claim on the property at the time of the sale β€” typically the former owner of record, then lienholders in order of priority. Counties generally require a written claim with proof of identity and proof of interest before releasing money.

    You have a claim if you owned the property on Date of the tax sale. Heirs of a deceased owner can also claim, usually through probate or a small-estate procedure.

  3. Gather your documents

    Typically a government-issued photo ID, proof of your current address, and the deed or another document showing you held title. Heirs will also need a death certificate and probate paperwork.

  4. File before the deadline

    File the claim form with the clerk. Confirm the current deadline with that office β€” missing it transfers the money out of their hands.

Forsyth County's Own Claim Process

Forsyth County publishes its excess funds listing directly on the Tax Commissioner's website as a table of tax sales. Each line shows the date sold, the parcel number, the name and mailing address the funds are recorded under, the property address, the purchase price, the taxes due, and the excess funds left over. The figures shown here are the excess funds column only.

The Tax Commissioner asks that all claim correspondence be directed to David D. Hicks, Tax Commissioner (ddhicks@forsythco.com, 770.781.2112). Mail is only received at the 1092 Tribble Gap Road office.

Excess funds are paid out in the order of priority set by O.C.G.A. 48-4-5 β€” the former record owner, then lienholders of record. Submit a written claim with proof of your interest in the property; the office may require an affidavit and, where claims compete, may interplead the funds into Superior Court rather than decide between claimants itself. Unclaimed balances are eventually remitted to the Georgia Department of Revenue as unclaimed property.
